FLEXPRO™ AFFILIATE PROGRAM
All FlexPro™ affiliates are subject to the following Terms and Conditions, which govern participation in the program and outline the rights and responsibilities of all parties involved.
1. EARNINGS
FlexPro™ affiliates earn the following commissions for every purchase made using their unique promo code:
- $40 for every initial FlexPass™ purchase.
- $80 for every initial BattlePack™ purchase.
- $40 for every FlexPass™ customer who upgrades to BattlePack™ within 6 months of their original purchase.
Affiliates are not entitled to earnings for any purchase in which their promo code is not used at the time of checkout. Upgrade bonuses apply only when the original FlexPass™ purchase was made using the affiliate’s promo code. Promo codes are non-transferable, limited to one per customer per transaction, and may not be stacked with other codes or offers. Sports University reserves the right to void earnings resulting from misuse, sharing, or unauthorized distribution of promo codes.
2. PAYMENT DATES
Payments to FlexPro™ affiliates are processed weekly. Payment processing begins each Monday. Depending on payment volume, transfers may take 24–72 hours or longer to reach affiliates. Sports University does not guarantee payment delivery within any specific timeframe but will make every reasonable effort to process all payments as quickly as possible.
3. CHARGEBACKS & PAYMENT DISPUTES
Commissions earned through the FlexPro™ Affiliate Program are contingent on the underlying customer payment remaining valid and undisputed. If a customer files a chargeback, dispute, or reversal with their bank or payment provider on a purchase or upgrade that generated a commission, the following applies:
3.1. Unpaid commissions. If the disputed commission has not yet been paid out to you, it will be voided and removed from your balance. No further action is needed on your part, and no funds will be withdrawn from you since none were ever paid.
3.2. Already-paid commissions. If the disputed commission was already included in a completed payout to you, the amount will be deducted from your future earnings. This deduction is applied as a line item against your next payout cycle, the same way a commission is credited — it will appear on your affiliate dashboard so you can see exactly which order it relates to.
3.3. Disputes resolved in our favor. If the chargeback is later reversed — for example, if the payment processor or bank rules in favor of sportsu.pro — any voided commission or clawback deduction tied to that order will be automatically reinstated to your account. You do not need to contact us for this; it is handled automatically once the dispute is resolved.
3.4. No commission on disputed or refunded transactions. Commissions are earned only on completed, undisputed payments. A transaction that is refunded, reversed, disputed, or otherwise not fully collected by sportsu.pro does not generate a payable commission, regardless of whether a payout has already occurred.
3.5. Repeated chargebacks. FlexPro™ reserves the right to review, suspend, or terminate an affiliate’s participation in the program if chargebacks tied to their referrals occur at a frequency that suggests fraudulent, incentivized, or otherwise improper signups.
3.6. Timing. Chargeback and dispute outcomes are determined by the customer’s card issuer or payment processor and are outside of sportsu.pro’s control. Resolution timelines vary and may take several weeks; commission adjustments described above will be applied as soon as sportsu.pro is notified of the outcome.
4. PAYMENT ISSUES
For any questions or concerns regarding payments, affiliates must contact Sports University at [email protected]. Once received, the issue will be reviewed and addressed as promptly as possible.
5. PAYMENT METHODS
Sports University currently supports the following payment methods for FlexPro™ affiliate payouts: CashApp and Apple Pay. Supported payment methods are subject to change at the sole discretion of Sports University. Affiliates who do not provide a valid CashTag or the phone number associated with their Apple ID will not be eligible to receive payments until such information is provided. Sports University is not responsible for payment delays or failures resulting from inaccurate or incomplete payment information provided by the affiliate.
6. TAXES & INDEPENDENT CONTRACTOR STATUS
FlexPro™ affiliates are independent contractors, not employees, agents, partners, or joint venturers of Sports University. Nothing in these Terms and Conditions shall be construed to create an employment relationship between Sports University and any affiliate.
As an independent contractor, you are solely responsible for determining, reporting, and paying all federal, state, local, and international taxes applicable to the commissions you earn through the FlexPro™ Affiliate Program. Sports University does not withhold income taxes, Social Security, Medicare, or any other taxes from commission payments on your behalf.
Sports University will issue a Form 1099-NEC to any U.S.-based affiliate who earns $600 or more in commissions during a calendar year, as required by the Internal Revenue Service. By participating in the FlexPro™ Affiliate Program, you agree to provide Sports University with accurate taxpayer identification information upon request, including a completed IRS Form W-9 (for U.S. affiliates) or Form W-8BEN (for non-U.S. affiliates).
Sports University is not responsible for any tax penalties, interest, underpayments, or other tax obligations incurred by you as a result of your participation in the FlexPro™ Affiliate Program. It is your sole responsibility to comply with all applicable tax laws and regulations.
7. ELIGIBILITY CONFIRMATION
By joining the FlexPro™ Affiliate Program, you confirm that your participation does not violate any athletic eligibility rules, NIL (Name, Image, and Likeness) restrictions, or governing body regulations applicable to you, including but not limited to rules established by the UIL, NCAA, NAIA, or any other high school, collegiate, or amateur athletic governing body.
8. YOUR RESPONSIBILITY TO KNOW THE RULES
It is solely your responsibility to determine whether your participation in the FlexPro™ Affiliate Program is permitted under the rules of your school, state, athletic association, or any other governing body with jurisdiction over your athletic eligibility. Sports University does not provide eligibility guidance and makes no representation regarding the eligibility status of any participant.
9. LIMITATION OF LIABILITY
Sports University bears no responsibility for any eligibility consequences, sanctions, or penalties resulting from your participation in the FlexPro™ Affiliate Program. By enrolling, you acknowledge that you have reviewed the applicable rules governing your eligibility and have determined that your participation is permitted.
10. COLLEGE ATHLETES & NIL COMPLIANCE
10.1. Independent NIL activity. Your participation as a FlexPro™ affiliate is separate from, and not sponsored, endorsed, or facilitated by, your school, athletic conference, or any collegiate athletic governing body. Sports University is not a party to, and assumes no responsibility for, your compliance with any NIL policy.
10.2. Disclosure obligations. Many colleges, universities, and athletic conferences require student-athletes to disclose NIL agreements — including affiliate or promo code arrangements like this one — to a compliance office, and some require pre-approval before you begin promoting or earning commissions. It is your sole responsibility to determine whether disclosure or pre-approval is required by your institution, conference, and state NIL law, and to complete that process before participating.
10.3. State law and institutional policy variance. NIL rules differ by state, by institution, and in some cases by conference, and are subject to change. You are responsible for staying current on the rules that apply to you. Sports University does not track, interpret, or provide guidance on any specific state’s NIL statute or any specific school’s NIL policy.
10.4. No conflicting representations. You may not represent, imply, or suggest that Sports University, FlexPass™, or BattlePack™ is sponsored by, affiliated with, or endorsed by your school or athletic program unless you have separate written authorization to do so. Promotional activity must comply with any restrictions your school places on the use of school marks, uniforms, facilities, or affiliations in NIL promotion.
10.5. Eligibility risk remains yours. This section supplements, and does not replace, Sections 7–9 above (Eligibility Confirmation, Your Responsibility to Know the Rules, and Limitation of Liability), which apply in full to NIL-related eligibility questions.
11. AGE REQUIREMENTS & USE OF MINORS
11.1. Affiliates must be 18 or older. The FlexPro™ Affiliate Program is open only to individuals who are at least 18 years of age. Sports University does not accept enrollments from minors, and no parent or guardian may open or hold an account on a minor’s behalf. Any account found to belong to, or be operated by, a person under 18 will be suspended and any pending balance forfeited.
11.2. Featuring minors in promotional content. If you are an eligible (18+) affiliate and choose to feature a minor in your promotional content — including your own child, athletes you coach, students, or any other minor — you are solely responsible for the following:
11.2.1. Consent. Obtaining valid, documented consent from the minor’s parent or legal guardian before filming, photographing, or otherwise using the minor’s name, image, or likeness in any content promoting FlexPass™, BattlePack™, any other Sports University product or service, or your promo code.
11.2.2. Likeness and content rights. Ensuring you hold or have secured whatever rights are necessary to use the minor’s likeness and any footage or images in your promotional content.
11.2.3. Child labor law compliance. Complying with any applicable state or federal child labor laws where a minor’s participation in your content could be considered work or performance, including any required work permits, hour restrictions, or earnings set-aside requirements (such as “Coogan Law”-style trust account rules that exist in some states for minors used in entertainment or advertising).
11.2.4. Disclosure obligations. Ensuring any content featuring a minor, made in connection with FlexPass™, BattlePack™, any other Sports University product or service, or your promo code, complies with applicable advertising disclosure requirements (such as FTC endorsement guidelines requiring clear disclosure of a material connection, e.g., “#ad” or “#sponsored”).
11.3. Sports University is not a party to this content. Sports University does not create, direct, request, or review promotional content produced by affiliates involving FlexPass™, BattlePack™, any other Sports University product or service, or a minor’s likeness, and bears no responsibility for an affiliate’s compliance with the requirements in Section 11.2. All consent, documentation, and legal compliance related to featuring a minor in promotional content rests solely with the affiliate.
11.4. Right to remove noncompliant content. Sports University reserves the right to request the removal of, or disassociate itself from, any promotional content involving a minor that appears to violate this section, and to suspend or remove the affiliate’s account for noncompliance.
12. AFFILIATE CONDUCT
As a FlexPro™ affiliate, you represent Sports University and are expected to promote the program honestly, accurately, and professionally. Affiliates may not make false or misleading claims about FlexPass™, BattlePack™, or any Sports University product or service. Sports University reserves the right to remove any affiliate found to be misrepresenting the program or conducting themselves in a manner inconsistent with the values and standards of Sports University, including but not limited to fraudulent activity, spam, or conduct that damages the reputation of the brand.
13. REMOVAL FROM FLEXPRO™
Sports University reserves the right to remove any affiliate from the FlexPro™ Affiliate Program at any time and for any reason. Upon removal, the affiliate’s promo code will be deactivated, and any outstanding balance owed will be paid on the next scheduled payment date.
14. OTHER CONSIDERATIONS
Any matters not addressed in these Terms and Conditions, as they relate to the FlexPro™ Affiliate Program, will be handled at the sole discretion of Sports University.
